NGCB Issues Cease-and-Desist Order to Playgon Interactive and Affiliate
The Nevada Gaming Control Board (NGCB) has issued a cease-and-desist order to Playgon Interactive Inc. and its affiliate, Bitrate Productions.
Compliance and Enforcement
This directive mandates the cessation of all unlicensed activities by 5 PM on July 26, 2024. The NGCB released details of this action on Thursday, revealing that the companies were initially notified on July 18, 2024.
The NGCB has emphasized that failure to comply with the order could result in criminal or civil actions. Under Nevada law, the cease-and-desist order authorizes the NGCB to investigate and prosecute any suspected violations of the state’s Gaming Control Act. Kirk Hendrick, chairman of the NGCB, reiterated the Board’s commitment to enforcing Nevada’s gaming laws and regulations.
“The NGCB will take all necessary actions to enforce Nevada’s gaming laws and regulations,” said Kirk Hendrick, highlighting the Board’s determination to ensure compliance within the industry.
Alleged Unauthorized Activities
Playgon had previously assured the NGCB in 2016 that Bitrate Productions’ activities did not require a gaming license as they were limited to social casino gambling, which is exempt from licensing under Nevada regulations.
However, recent allegations suggest that Bitrate’s operations extended beyond social gaming.
The NGCB’s recent letter asserts that Bitrate hosted live dealer games, including roulette and baccarat, in Las Vegas, broadcasting these games to online gambling operators worldwide.
While broadcasting games for entertainment purposes does not require a license, conducting such broadcasts for real gambling purposes does necessitate proper licensing under Nevada law.
