Evolution Gaming Secures Temporary Confidentiality in Lightning Roulette Case
Evolution Gaming has secured permission to file a redacted version of its complaint in the ongoing Lightning Roulette infringement case against Light & Wonder (L&W).
Nevada magistrate judge Elayna Youchah ruled in favor of Evolution’s request, recognizing the need for temporary confidentiality until L&W formally responds to the allegations.
Nature of the Dispute
The core of the dispute lies in Evolution’s accusations that L&W infringed on its intellectual property related to the popular Lightning Roulette game.
Evolution contends that L&W created several copycat products, using proprietary information obtained from a failed collaboration project.
Specifically, Evolution claims that L&W leveraged proprietary mathematical files in their Roulette X and PowerX products.
Confidentiality and Legal Arguments
Initially, Evolution sought to keep several sections of its complaint confidential, citing existing confidentiality agreements between the two companies. The rationale was to prevent sensitive information from becoming public during the early litigation stages, which could complicate the case and hinder the lawsuit’s progress.
The court, however, initially expressed skepticism, emphasizing the general legal principle that favors public access to court records.
Judge Youchah underscored the need for transparency, particularly in legal proceedings that could impact public interest and industry standards. She ordered Evolution to submit a memorandum by June 10, providing a compelling justification for the sealing request.
Temporary Redaction Approval
After reviewing Evolution’s arguments and considering the confidentiality agreements between the parties, Judge Youchah acknowledged a compelling reason for temporary redactions. The court recognized the potential harm to Evolution’s competitive position and the integrity of ongoing legal negotiations if sensitive information were disclosed prematurely.
The judge’s decision to allow redactions is temporary, with a more detailed review expected once L&W responds to the allegations. This ruling provides Evolution with a strategic advantage as it navigates the complexities of the ongoing lawsuit.
